Official Rules.

NO PURCHASE NECESSARY TO ENTER OR WIN. Making a purchase will not increase your chances of winning. Internet access is required.

1. Eligibility: The Don’t Let it Burn Contest (hereafter, “Promotion”) is open only to legal residents of the forty-eight (48) contiguous United States and the District of Columbia (excluding Alaska and Hawaii) who are twenty-one (21) years of age or older as of the date of entry. Employees, officers, directors, agents and representatives of Takeda Pharmaceuticals U.S.A., Inc. (hereafter, “Sponsor”), Ketchum Inc., Project Support Team, Inc. and each of their respective parent companies, affiliates, subsidiaries, wholesalers, retailers, distributors, suppliers, public relations, advertising and promotion agencies (hereafter collectively, “Released Parties”), and each such individual’s immediate family members (defined as spouse, biological, adoptive and step-parents, grandparents, children, grandchildren, siblings, and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related, are not eligible to participate or win. In addition to the above, health care professionals who are licensed to prescribe pharmaceutical products and persons employed by such health care professionals are not eligible to participate or win. Void in Alaska, Hawaii, outside of the forty-eight (48) contiguous United States, and where prohibited by law. Promotion is subject to all applicable federal, state and local laws.

2. Promotion Period: The Promotion starts 12:00:01 am (right after midnight) Eastern Time (“ET”) on 5/2/12 and ends 11:59:59 pm (right before midnight) ET on 6/13/12 (hereafter, “Promotion Period”).

3. Contest/Entry Overview: To participate, eligible entrants must submit the following, as outlined in “How to Submit Entry” (Rule 5, below) during the Promotion Period: An original recipe (“Recipe”) for a dish that is appropriate for people with ARD (acid reflux disease) (“Theme”). The Recipe must not include more than 10 ingredients or be in excess of five hundred (500) words (including counting words such as “I”, “a”, etc.) and must conform with the Entry Requirements below. Recipe should avoid foods that may increase acid reflux symptoms, such as onions, garlic, chocolate, spicy foods, tomato-based products, citrus juice, high-fat foods, fried foods, peppermint, cola (carbonated beverages), tea, coffee and caffeine. Additionally, eligible entrants may submit, optionally, an original, unaltered digital color photo of entrant’s finished recipe plated (the “Photo”) (only a finished Recipe may appear in Photo). Recipe, Photo (if applicable) and registration form shall be collectively referred to hereafter as the “Entry”. Uploading a Photo is optional and will not increase your chances of winning. Note to entrants who elect to submit Photos: If the original Photos were saved at a lower resolution and attached to the registration form, save the original high resolutions for potential future use by Sponsor and its designees, in  their sole discretion, in accordance with the relevant provisions of these Official Rules.

4. Entry Requirements: By entering Promotion, each entrant agrees that his or her Entry conforms to these Entry Requirements and that Sponsor, in its sole discretion, may disqualify an Entry from the Promotion if it believes, in its sole discretion, that entrant’s Entry fails to conform to these Entry Requirements in any way. 

A) Recipe Entry Requirements:

  • Originality: Recipe must be entrant’s own original recipe. Note: Original is defined as a recipe created solely by the entrant that is not a copy or imitation of another person’s recipe. 
  • List of ingredients: Recipe ingredients must be disclosed using exact standard U.S. measurements, e.g., cup, teaspoon, ounces, etc. All ingredients must be edible. Recipe must NOT include alcoholic beverages.
  • Number of ingredients: Recipe must include no more than 10 ingredients. Recipes including more than 10 ingredients will be disqualified. 
  • Number of words: Recipe must not exceed five hundred (500) words, inclusive of words such as “I”, “a”, etc.
  • Instructions: Recipe should be easy-to-follow, only require standard kitchen appliances and include complete step-by-step preparation and cooking instructions, cooking times, cooking heat level, utensils required, number served, and type of appliances utilized.
  • Time: Recipes must not take more than 45 minutes to make.

B) Optional Photo Requirements: 

  • Originality: Photo must be an original photograph on which no image editing software has been used.
  • Format: Photo must be saved as a .jpg, .jpeg or .png file not exceeding 10 MB in size.
  • Photo: Must include ONLY the finished, plated Recipe and must have been taken by entrant.
  • Limit 1 Photo per Recipe.

C) Entries (including Recipe and/or Photo (if applicable)):

  • Must be in English.
  • Must be entrant’s original creation (as defined previously) and solely owned by entrant. 
  • Should not have been previously published or submitted in any competition or have won any awards.
  • Should not include trademarks, logos, packaging or copyrighted material not owned by entrant or used without permission (such as third-party packaging or company names or brand names);
  • Should not violate publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or proprietary rights, including but not limited to intellectual property rights, without permission;
  • Should not disparage any person or party, including Sponsor or anyone affiliated with the Promotion and administration of this Promotion;
  • Should not contain text that is inappropriate, indecent, obscene, hateful, tortious, defamatory, slanderous or libelous, as determined solely by Sponsor and/or the judges;
  • Should not contain content that is sexually explicit or suggestive, derogatory, profane or pornographic; promotes alcohol, contains alcoholic beverages; promotes illicit drugs; or promotes any activities that may appear unsafe or dangerous, as determined solely by Sponsor and/or the judges;
  • Should not promote any particular political agenda or message or endorse any form of hate or hate group;
  • Should not communicate messages or images inconsistent with the positive images and/or good will to which Sponsor wishes to associate;
  • Should not violate or encourage others to violate any law;
  • Should not provide personally identifiable information about entrant or any other person, such as last name, address, phone number or any contact information (except for entrant’s personal information s/he is required to provide for entry in accordance with these Official Rules);
  • Must be submitted in the name of one entrant only; and/or
  • Must not violate any agreement to which entrant is a signatory or party.

The above list is not intended to be exhaustive; Sponsor may disqualify an Entry along with the entrant who submitted it, if it includes any content which, in Sponsor’s or the judges’ opinion, is inappropriate, objectionable or unsuitable for publication in connection with this Promotion, or is not in keeping with Sponsor’s image, or is in violation of these Official Rules in any way. Sponsor reserves the right to reject and disqualify an Entry at any time, in its sole discretion, without incurring any liability.

Without limiting any of the other rights granted herein, submitting an Entry constitutes entrant’s consent to grant Sponsor the irrevocable, unlimited, absolute right and license to use, reproduce, modify, publish, create derivative works from, license to third parties and display such Entry (including the Recipe and Photo (if applicable), in whole or in part, on a worldwide basis, in perpetuity, and to incorporate it into other works, in any form, media or technology now known or later developed, including, but not limited to, on www.DontLetitBurn.com and other websites as determined by Sponsor and on Sponsor’s social media pages (where it may be viewed by all visitors), for any purpose whatsoever, including but not limited to trade, advertising, promotional or marketing purposes, without consideration or attribution to entrant, without review or approval by entrant, and without compensation of any kind or additional notice to entrant. Entrant agrees that Released Parties (as defined herein) are not responsible for any unauthorized use of Entries and/or Photos by third parties. Released Parties do not guarantee the posting of any Entry on any website. Entrants agree that they will not use the Entry for any purpose other than this Promotion, including, without limitation, posting the Entry and/or Photo to any online social networks, without the express consent of Sponsor in each instance. Each Entrant acknowledges and agrees that s/he will not now or in the future be paid or compensated in any way for his/her Entry, or for granting the Sponsor any of the rights set out in these Official Rules, and that Sponsor is not obligated to make use of any of the rights granted in these Official Rules.

By submitting an Entry, entrant acknowledges and agrees that Sponsor may obtain many submissions under this Promotion and that such Entries may be similar or identical in theme, idea, format or other respects to others submitted under this Promotion and/or other Promotions staged and/or sponsored by the Sponsor, or to other ideas conceived by or provided to Sponsor and entrant waives any and all claims entrant may have had, may have, and/or may have in the future, that any Entry and/or other works accepted, reviewed and/or used by the Sponsor (or its designees) may be similar to his/her Entry. Except where prohibited by law, each entrant acknowledges and agrees that the Sponsor does not have now, nor shall it have in the future, any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of any copyright in and to entrant’s Entry.

5. How to Submit Entry/Entry Limitations: Visit www.DontLetitBurn.com (“Site”) during the Promotion Period and follow the instructions to complete and submit the registration form, inclusive of entrant’s Recipe and optional Photo. Incomplete Entries and/or Entries containing inaccurate entrant information will be disqualified at Sponsor’s sole discretion. Entries must be received by 11:59:59 pm ET on 6/13/12 to be eligible. The use of script, macro or any other device to automate or subvert the entry process is prohibited. Any Entry made through such means will be void and ineligible for inclusion in the Promotion, and any person who submits such an Entry will be disqualified and ineligible to participate or win a prize. In the case of a dispute as to the entrant who submitted an Entry, Entry will be deemed made by the person named on the applicable registration form (regardless of whether that is the name of the authorized account holder of the email address from which said Entry was submitted) and he/she must comply with these Official Rules. Other than as otherwise specified herein, neither Sponsor, nor anyone acting on its behalf, will enter into any communications with any entrant regarding this Promotion (except for the purposes of notifying the winner or runners up at the discretion of the Sponsor) or acknowledge any Entry (or portion thereof) received. Any Entry not meeting all Entry requirements stated herein will be disqualified. Proof of submission of an Entry does not constitute proof of receipt of Entry by Sponsor or its designees.

Limit one (1) Entry per person/per email address, per day of the Promotion Period. Additional Entries received from the same person and/or same email address in excess of the stated daily limitation will be void. Entrants are not permitted to submit the same Entry (including the same Recipe) more than once during the Promotion Period and each Entry (including the Recipe) must be unique and substantially different from all Entries previously submitted by such entrant. Identical Entries submitted from the same entrant or members of his/her household will be void.

6. Entry Judging: Between 6/14/12 and 6/15/12, all eligible Entries received will be judged and scored on the following judging criteria (“Judging Criteria”) by a panel of qualified judges determined by Sponsor in its sole discretion: (1) Recipe’s Relevance to the Theme (as defined in Rule 3, above): 0-40 points; (2) Nutritional Value: 0-30 points; and (3) Recipe’s Originality: 0-30 points.  In the event of a tie, the higher/highest score for the Recipe’s “Relevance to the Theme” criterion will determine winner. If there is still a tie, the higher/highest score for the “Originality” criterion will determine the winner. By participating, entrants agree to abide by these Official Rules and the decisions of the Sponsor and judges, which are final and binding in all matters relating to this Promotion, and further agree to be bound by Sponsor’s Terms of Use, located at http://www.tpna.com/home/terms_of_use.aspx.

7. Winner Notification: Potential winners will be notified on or about 6/15/12 by telephone and/or overnight mail and/or regular mail. Potential Grand Prize winner will be required to execute and return an Affidavit of Eligibility, Liability and (where legal) Publicity Release (“Affidavit/Release”), rights transfer document and/or any other documents required by Sponsor within two (2) calendar days of date of issuance of notification. Additionally, potential Grand Prize winner may be required, at Sponsor’s sole discretion, to provide proof or verification of identity and qualifications. Potential Grand Prize winner understands and agrees that, as a condition of awarding the prize, Grand Prize winner will be subject to a background check. Failure to comply may result in disqualification and, based on the Judging Criteria described above and time permitting, selection of an alternate winner. In addition, at the discretion of the Sponsor, potential Grand Prize winner may be disqualified for any of the following: if charged with or convicted of a felony or misdemeanor; if Sponsor determines, in its sole discretion, that awarding a prize to such individual may reflect unfavorably on the Promotion or Sponsor; or if s/he is not eligible based on the eligibility requirements set forth above. Potential Runner-up winners may be required to execute and return an Affidavit/Release, rights transfer document and any other documents required by Sponsor within the time frame provided by Sponsor. Noncompliance with any of the foregoing, with these Official Rules, the inability to contact a potential winner within a reasonable time period or any notification being returned as non-deliverable may result in disqualification and, at Sponsor’s discretion, and, based on the Judging Criteria described above and time permitting, selection and notification of an alternate runner-up. Winner status (at either prize level) is subject to verification of eligibility and compliance with these Official Rules. 

8. Prizes:

One (1) Grand Prize: Dinner, prepared by celebrity chef, Spike Mendelsohn, for winner and one (1) guest at winner’s home on a date designated by Sponsor (anticipated to take place between 6/26/12 and 6/28/12). Additionally, winner will have the option of preparing the dinner with the chef. Approximate Retail Value (“ARV”) of Grand Prize: $900.00. Exact date, time, menu, duration of visit, and level of involvement in preparing dinner (if so selected) is at Sponsor’s sole discretion. Grand Prize winner must be available on dates specified by Sponsor, subject to Spike Mendelsohn’s schedule, or prize will be forfeited and may be awarded to an alternate winner based on the Judging Criteria described above. Sponsor is not responsible if dinner with Spike Mendelsohn is delayed, postponed or canceled for any reason. In such event, Sponsor shall have the option, in its sole discretion, to substitute a different prize or prize activity/event/meeting. Dinner with Spike Mendelsohn is based on his availability. Services provided by Spike Mendelsohn are subject to his terms and conditions. Grand Prize winner agrees to sign any additional releases and/or documents that may be required to allow Spike Mendelsohn to cook in Grand Prize winner’s home. Grand Prize winner’s guest will be required to sign a release prior to dinner. In order to accept this prize, Grand Prize winner must have a fully functioning kitchen (e.g., running water, functioning stove, etc.) in his/her home.

Two (2) Runner-up Prizes: Each Runner-up winner will receive The Good Stuff Cookbook, signed by Spike Mendelsohn. ARV of each Runner-up Prize: $30.00. 

ARV of all prizes combined: $960.00. Limit one (1) prize per person. Prizes consist only of the items described above. Costs and expenses associated with the acceptance and use of a prize not specified herein as being awarded are each winner’s sole responsibility. Any difference between the ARV and the actual value of a prize will not be awarded. Prize is awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. All prize details are at Sponsor’s sole discretion.  Each winner is responsible for payment of all federal, state and local income taxes on his/her prize. The Grand Prize winner will be issued an IRS Form 1099 for the value of the prize.

9. Miscellaneous: No transfer, assignment, cash redemption, or substitution of any prize except by Sponsor who reserves the right to substitute a prize with one of equal or greater value, as determined by Sponsor, in the event a prize is unavailable. By entering, entrants and winners agree to release and hold harmless the Released Parties from and against any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, or participation in Promotion, or possession, acceptance and/or use or misuse of a prize or participation in any Promotion-related activity (including, but not limited to, preparing and/or eating dinner) and for any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property-related cause of action. Each winner agrees that Sponsor and its designees may use winner’s name, address (city and state), likeness, photograph, picture, portrait, voice, biographical information, and/or any statements made by each winner regarding the Promotion or Sponsor for advertising, trade and/or any other purposes in any media (including but not limited to online at www.DontLetitBurn.com and Sponsor’s social media pages) now or hereafter known throughout the world in perpetuity, without limitation or compensation, and without further permission or notification (except where prohibited by law). Sponsor reserves the right, in its sole discretion, to modify, terminate or suspend this Promotion should virus, bugs, fraud, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or proper play of the Promotion and, in the event of termination prior to the stated end date of the Promotion Period, at its discretion, to select the prize winners from those eligible, non-suspect Entries received prior to event requiring such termination using the judging procedure/criteria outlined herein. 

10. General Conditions: Submission of an Entry constitutes entrant’s representation of eligibility and consent for Sponsor to obtain, use and transfer entrant’s name, address and other information for the purpose of Promotion administration. Released Parties are not responsible for: lost, incomplete, invalid, unintelligible, inaccurate, undeliverable, garbled, late, delayed, damaged or misdirected Entries or Photos, all of which will be disqualified; failures or malfunctions of phones, phone lines or telephone systems or other communications or malfunctions; interrupted or unavailable network, server, cable, satellite, Internet Service Provider (ISP) or other connections; miscommunications, failed computer hardware or software or other technical failures affecting the transmission, receipt or processing of Entries; garbled, lost, misrouted or scrambled transmissions; any error (human, technical or otherwise), omission, interruption, defect or delay in any transmission or communication; traffic congestion on the Internet or for any technical problem, including but not limited to any injury or damage to entrants’ or any other person’s computer or other device related to or resulting from participation in the Promotion; theft, destruction of or unauthorized access to, or alteration of, Entries or Photos; human error; printing, typographical or other errors or omissions in these Official Rules or in any Promotion-related advertisements or other materials; other errors or problems of any kind whether mechanical, human, technical, network, electronic; or errors which may occur in connection with the administration of the Promotion, the incorrect uploading of Entries or Photos, the processing or judging of Entries, the awarding or announcement of the winners or in any Promotion-related materials; any Entries submitted in a manner that is not expressly allowed under these Official Rules; incorrect or inaccurate Entry information whether caused by entrant or by any of the equipment or programming associated with or utilized in the Promotion; or cheating or fraud by any entrant. Sponsor reserves the right to void and remove any and all Entries of an entrant who Sponsor believes has attempted to tamper with, influence, or impair the administration, security, fairness, judging or proper play of Promotion and such entrant will be disqualified and all associated Entries will be void. Entries and Photos will not be returned. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

11. Arbitration: Except where prohibited by law, as a condition of participating in this Promotion, entrant agrees that: (1) any and all disputes and causes of action arising out of or connected with this Promotion, or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the entrant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction.

12. Choice of Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the substantive laws of the State of Illinois without giving effect to any choice of law or conflict of law rules (whether of Illinois or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Illinois.

13.  Limitation of Liability; Disclaimer of Warranties: IN NO EVENT WILL THE RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE SERVICE AND/OR THE PROMOTION, DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITES ASSOCIATED WITH THE PROMOTION. IN NO EVENT SHALL THE RELEASED ENTITIES’ TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED $10. WITHOUT LIMITING THE FOREGOING, THIS PROMOTION AND ALL PRIZES ARE PROVIDED "AS IS"  WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

14. Severability; Inconsistencies: The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Promotion-related materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern and control.

15. Use of Data: Sponsor will be collecting personal data about entrants online, in accordance with its privacy policy. Please review the Sponsor’s Privacy Policy at http://www.tpna.com/home/privacy_policy.aspx. By participating in the Promotion, entrants hereby agree to Sponsor’s collection and usage of their personal information in accordance with Sponsor’s Privacy Policy and acknowledge that they have read and accepted Sponsor’s Privacy Policy.

Uses of DEXILANT (dexlansoprazole) 30 mg and 60 mg delayed release capsules

Persistent heartburn two or more days a week, despite treatment and diet changes, could be acid reflux disease (ARD). Prescription DEXILANT capsules are used in adults for 4 weeks to treat heartburn related to ARD, for up to 8 weeks to heal acid-related damage to the lining of the esophagus (called erosive esophagitis or EE), and for up to 6 months to continue healing of EE and relief of heartburn. Individual results may vary. Most damage (erosions) heals in 4–8 weeks.

Important Safety Information

DEXILANT may not be right for everyone. Do not take DEXILANT if you are allergic to DEXILANT or any of its ingredients. Serious allergic reactions have been reported. Tell your doctor if you get any of the following symptoms with DEXILANT: rash, face swelling, throat tightness, or difficulty breathing. Symptom relief does not rule out other serious stomach conditions. People who are taking multiple daily doses of proton pump inhibitor (PPI) medicines for a long period of time may have an increased risk of fractures of the hip, wrist, or spine. Low magnesium levels can happen in some people who take a PPI medicine.

The most common side effects of DEXILANT were diarrhea (4.8%), stomach pain (4.0%), nausea (2.9%), common cold (1.9%), vomiting (1.6%), and gas (1.6%). DEXILANT and certain other medicines can affect each other. Before taking DEXILANT, tell your doctor if you are taking ampicillin, atazanavir, digoxin, iron, ketoconazole, or tacrolimus. If you are taking DEXILANT with warfarin, you may need to be monitored because serious risks could occur.
